We granted certiorari to review In re Marriage of Lampton, 677 P.2d 352 (Colo. App. 1983), in which the court of appeals reversed the district courts award of joint custody of the parties minor child in a marriage dissolution proceeding. The court of appeals held that joint custody cannot be awarded in the absence of an agreement between the parties. We conclude that the district court abused its discretion in awarding joint custody and joint control under the facts in this case, and return the case to the court of appeals for remand to the district court for a new hearing.
